1. Operator and Scope

These Terms of Use govern access to and use of the website xiphranntrsmyx.world (the "Website"), operated by Xiphranntrsmyx, Annastraße 68A, 45130 Essen, Germany ("we", "us", "our"). By accessing the Website, you agree to these Terms. If you do not agree, please do not use the Website.

2. Nature of the Website

The Website provides information about our food supplement product Teravion and allows consumers to submit order enquiries. Teravion is a food supplement (Nahrungsergänzungsmittel) within the meaning of Directive 2002/46/EC and the German Food Supplement Regulation (NemV). It is not a medicine, medical device or medicinal product.

3. Eligibility

You must be at least 18 years of age to use this Website and to purchase our products. By submitting an order, you confirm that you are an adult. We reserve the right to decline orders from minors.

4. Order Process and Contract Formation

Submitting the order form on this Website constitutes an offer to purchase the relevant product. A binding contract is only formed when we send you a separate order confirmation by email. We reserve the right to decline any order at our discretion, for example if we are unable to verify your contact details or if the product is out of stock. In that event, any payment already taken will be refunded in full.

5. Prices and Payment

All prices shown on the Website are in Euros (€) and include German VAT (Mehrwertsteuer) at the applicable rate, unless otherwise stated. We reserve the right to adjust prices at any time before contract formation. Accepted payment methods will be stated at the point of order. We do not store your payment card details on our servers.

6. Delivery

We deliver within Germany. Delivery times are estimated and not guaranteed. Risk of loss transfers to you upon delivery. If a delivery fails due to circumstances attributable to you (e.g., incorrect address), re-delivery costs may be charged.

7. Right of Withdrawal (Widerrufsrecht)

As a consumer within the EU you have the right to withdraw from this contract within 14 days without giving any reason, in accordance with § 355 BGB (German Civil Code) and Directive 2011/83/EU. Please see our Return Policy for the full withdrawal notice and instructions on how to exercise this right.

Please note that the right of withdrawal does not apply to sealed goods which have been opened after delivery, where such goods are unsuitable for return for reasons of hygiene or health protection (§ 312g(2) No. 3 BGB). This may apply to opened supplement packs.

8. Product Information and Disclaimers

All product information on this Website is provided for informational purposes only. Teravion is a food supplement and is not intended to diagnose, treat, cure or prevent any disease or health condition. Health claims on this Website are EU-authorised claims pursuant to Regulation (EC) No 1924/2006 and apply only to the relevant nutrients and conditions stated in the Annex to that Regulation. Individual experiences with food supplements vary and depend on personal circumstances. Always read the label. Do not exceed the stated daily amount. Consult a healthcare professional if you have any medical concerns.

9. Intellectual Property

All content on this Website — including text, images, graphics, logos and code — is the property of Xiphranntrsmyx or its licensors and is protected by applicable copyright and intellectual property laws. Reproduction or redistribution without our prior written consent is prohibited.

10. Liability

We are liable without limitation for damages arising from wilful misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit), or from injury to life, body or health. In all other cases, our liability is limited to foreseeable, typical damages in the case of a breach of a material contractual obligation (wesentliche Vertragspflicht). We are not liable for the content of external websites linked from our Website.

11. Governing Law and Jurisdiction

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for disputes with traders is Essen, Germany. Consumers retain the right to bring proceedings before the courts of their habitual residence within the EU.

The European Commission provides an online dispute resolution (ODR) platform for consumer disputes: https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution before a consumer arbitration board and do not currently do so.

12. Amendments

We reserve the right to amend these Terms at any time. The current version is always published on this page. Continued use of the Website after changes constitutes acceptance of the revised Terms.
